Question about Legal DEADLINE!!!

I have several spots due in hours. They all need legal and they all need to be HD and SD centercut. I have been told to make the legal 22 pixels high for upper and lower case legal copy. If I make the legal 22px in HD then scale down the HD comp inside SD the legal isn't 23 pixels high. A dub house is going to downcovert from the HD to make all versions. Can anyone please advise as to whether or not legal is going to be big enough in SD if it is scaled down in the way described.

Was this 22-pixel-high specification made for SD video or HD video?
Is the producer or legal person aware that 22 pixels high in SD is larger than 22 pixels high in HD... and that there are TWO different vertical resolutions for HD, which influence the relative size of the text?
Go get your clarification right away.
