Legal to sell old FC studio stuff?
on Oct 3, 2009 at 2:58:34 am

So can I sell my FC studio 2 box with all things in it if I've upgraded to FC Studio 3? Is there a license problem in selling my FC studio 2 items?

Thanks

Kent,

If you purchased the upgrade package of FCS3 you cannot legally sell FCS2 to another user. On the other hand, if you purchased the full FCS3 package, not the upgrade, you could.

Does this make sense?

Right.
in the moment you sell the FCS2 you are not legally entitled to use the upgrade.

Makes sense, but not money :) So what does one do with the old stuff? At what point is it legal to sell old software if one continually upgrades as the new one comes out?

[Kent Beeson] "So what does one do with the old stuff? "
if you upgrade, you can not consider your FC2 as old stuff. is just a piece of FCS3.
Apart, the guy who will buy it won't have the right to upgrade.

Kent,

If you need the dough and want to do something illegal to get it, just go rob a bank. It's much more lucrative than selling your old Apple software, and what's the worst that could happen anyway? So, you get caught and get sentenced to 20-years... Big deal, you'll probably only have to do 10 of those years, and you'll probably have a hot date every night for the entire duration. His name might be Big Bubba or something like that, but he'll probably treat you really well.

Big Bubba and his friends might be willing to buy your software from you to while you're in the big house. You may come out ahead...and from behind.

Door stop or boat anchor. I have a boatload of old software that is obsolete, that's just the way it is. Not to mention hardware, for instance, I can't put Snow Leopard or FC Studio on my 3 year old G5. Go figure.

you could however sell your old software to someone who is less financially able, not for a "profit" but it will do more good then rotting in an attic.

This is what I had in mind to begin with, never for profit, maybe a couple 100 bucks, just better than collecting dust..but according to many replies, not even this is legal? So old software just sits there for years I guess.

Suppose we could just give it all away to a school or something...

Not legal. Not even if you sell it for $5.00. You can't even give it away!

I meant to write hardware, is there some way I can edit my post?

You can do anything you want with the hardware, BUT you can't legally leave the software on the machine UNLESS you transfer the licenses to the buyer.

And you CAN'T transfer the licenses of the old software if you're still using the upgrade.

I too am wondering about this... I bought Final Cut Studio 3 about 16 months ago, loaded it on two computers, and never really got over the learning curve. (I'm a still guy, trying to adapt... I've just been delegated the editing.) I want to become a better editor, but it's hard to teach an old dog new tricks.

That said, now with FCP X out, it looks so much friendlier, intuitive and visual. I know pros are balking, but perhaps for a guy like me who's not yet comfortable with FCP, it's a great way to go.

Should/could I sell Studio 3? Is it legal? Doesn't it make sense to stay current and go with X? So many questions!

Thanks for any wisdom you can offer.

Keith

If you have a previous version of Final Cut Pro - i.e. Final Cut Pro through when they when to Studio, that the Final Cut Studio 2 package you have upgraded, then, according to the gentleman I spoke with at Apple, you can sell it.

i.e. I own Final Cut Pro 1. I upgraded to Final Cut Studio 2 (Pro to Studio Upgrade). I'm considering an upgrade to Final Cut Studio 3. According to section #3 "Transfer" of the SLA (found on Apple's site), I can sell my Final Cut Studio 2 upgrade, and then upgrade to Final Cut Studio 3 using my Final Cut Pro 1 disk. I confirmed this with the Final Cut Studio rep at Apple (via the support phone line).

What I can't do, is sell both my Final Cut Studio 2 disk AND my Final Cut Pro 1 disk, and still keep a Final Cut Studio 3 upgrade.

Hope this helps!
