Replication problem, who's fault?

I had someone author a dvd for me, the dvd was dvd9 so he exported it to (2) DLT and then burnt me a couple of copies of the film on dvd9r, the DLT's were then sent to the replicator and the burnt discs sent to me, the burnt discs worked fine but when I took delivery of the manufactured discs they did not work properly, firstly one of the buttons on the main menu did not work, secondly at 1 hour 24 minutes into the film it goes pixilated and when it clears the film is about 2 minutes foward from where it should be (the counter on the player does not skip).
I have been in discusion with the manufacturers and they were saying it was an authoring problem but I argued because the burnt discs work fine! They have just sent me an email saying that their test shows: 'Line 193 and 197 marks error - wrong address - error of authoring software or of the creator of the authoring.'
I could possible accept this but the guy that authored the disc told me that he exported to dlt and as soon as that finished he exported exactly the same info to an iso image from which he burnt me a couple of discs which work fine.
The manufacturers also sent a master report which I have cut and pasted here:

Did the person who Authored the DVD update DVD Workshop 2.x with the DLT Patch issued last year?

Out of curiosity, the button that does not work -- would that button take you to an area of the DVD that would be on the 2nd layer (when the project is burned to DL Disc)?

Also, at the 1:24:00 mark, would that be around/near a layer break (again, if it were burned to DVD9)?

Did the images provided to the Replicator pass their verification process (before doing the print run)?

I am waiting to find out if they used the DLT update.
yes the button should take you to an area on the second layer
I think the 1:24:00 mark is near the break as the total run time of the DVD is 2:55:00
The DLT was verified after it was recorded by the Authorer

Did the check discs from the replicator exhibit the problems you are complaining about? Or did you not get check discs? It is foolish to proceed with a replication job without obtaining check discs and verifying their correct operation in a number of different DVD players.

That bit of business aside, if the DVD author can burn a good DVD-R of the project, there should be no problem replicating from DLT tapes, provided that the DLTs are good and the authoring software formats the project correctly. To check the DLTs, burn a DVD-R from the data on the DLTs, and check for the problems you are experiencing.

I did not get check discs from the replicator.

the problem I have is that the replicators say that if they send me the DLTs it will invalidate any claim I have against their company because I could 'doctor the tapes' they did say that if I give them the address of an independant company that can test the DLTs they will do that but obviously I will have to pay for that if it does turn out to be an authoring problem which is why I am seeking advice on this forum.

Hi Trai, I know that would be the answer but before we do anything like that I need to be pretty certain it is the replicators fault otherwise it is going to be a very expensive mistake.

Very good, Soofercat,

Just know, that at this stage, everyone's in cover their you-know-what mode. Your good author has no way of knowing what was sent in, he didn't really 'verify' the DLT tapes (please see the second page of this article, here); and the replicator just manufactured a DVD that doesn't work, regardless of who's at fault. Ouch.

As far as costs go; you wouldn't happen to be an Indie Film maker would you? If not, then at least you'd soon be limping around and batting one handed, with a working DVD :-)
