License Swap?

License Swap?

So, in light of the fact that FCS3 is a discontinued product, what is the legality of us "swapping" serials for these? I know there are several facilities around the country that were caught mid-transition by this roll out and are still in need of FCS3 seats. Anyone have any insight into this? I know we need a couple more seats, for the short term, until this whole thing shakes out.

I'll except private emails, should anyone want to discuss it in such a manner. We're just trying to figure out how to deal with the next 6 months, now that we're high and dry. Interestingly, it appears that existing FCS3 product is starting a VERY rapid evaporation as Apple recalls all copies. I saw this morning that B&H have discontinued selling it as well.

I have no idea what you mean by "swapping" serials, but I suspect it's not a legitimate solution. The problem is, when companies leave no legitimate solutions, what alternatives are there? There are moral, ethical, and legal issues that are very tough to deal with for most.

Doesn't seem totally "moral, ethical or legal" what Apple has done to the professional editing community. Maybe I'm trying to "rationalize" a solution for getting by the next few months. I guess by "swapping" I mean a kind of scenario where I've got a serial, you've got a serial, we both need a few more seats to get through the next month or so, and we trade numbers to get a couple of working seats. We certainly don't like this kind of solution, nor frankly advocate it, but I'm scratching my head trying to come up with another solution for these challenging days that are going to be the next month or two.

I realize the correct moral, ethical and legal thing to do would be simply migrate on to a different solution, but making that happen expediently is a bit of a chore. This whole thing has caught us in mid-transition with no real path forward. Can I see a solution for the next year? Sure. Can in happen in the next 30 days, maybe. Is work still coming in the door? Absolutely. It's like the scene from the Python movie where the "efficiency" expert moves one small item at the blacksmith shop and the whole operation falls apart. Well, perhaps not that extreme, but still it is a plan that was substantially interrupted and I'm trying to stick to the plan, short term, until we create another plan to move forward.

eBay?

Buy academic versions on eBay for that matter. They're cheaper. The only downside of academic versions are that they're not upgradeable. Guess that's not really an issue anymore is it?

It's not as if Apple loses sales of FCS 2009 now if you were to swap serials... so where's the moral dilemma over this? I mean, who are you stealing from? Can't see the problem with this on moral grounds.. maybe somebody should explain that to me as I don't understand something about it?

It is illegal, and the chances are you won't get caught, but just because there's no one in the forest to hear that tree fall down, it still makes a noise.

Anger and frustration because we may feel we've been screwed by "big brother" do undoubtedly make us feel justified in getting back at the big corporation, but the truth is, it's illegal all the same, and you should at least contemplate that before rationalizing an act does have legitimate legal, ethical, and moral implications.

Trust me Jerry, I'd think Apple has set themselves up in such a way that thousands of users will probably feel quite justified in declaring "open season" on all things Apple, and Apple probably deserves whatever they get. But, just because everyone feels justified, it doesn't take away the reality that moral, ethical, and legal questions still do actually exist.

The terms of the license likely make it illegal. I'm no lawyer. Nor do I intend to swap serials or anything of the sort. You'll not need to in most cases anyway. Caught in the middle? Buy from ebay or whatever. Just not going to be policed though. What a weird world we live in.

What's moral/ethical and what's legal are two different things. I don't condone swapping it on legal reasons alone. So ethically you need to be legal. I doubt there's room for an interpretation of the agreement that makes it null and void if the software is no longer supported.
