using same footage for another film
by Oliver Dickinson on Mar 25, 2009 at 11:39:29 am

Hi,

A friend of mine will be having his film broadcast in a month or so on a TV channel in the UK.
He filmed everything and owns all copyright. Let's say the title is "Elephants in Angola"

Can he make a second film, called "The life of Elephants", using some of the footage used in "Elephants in Angola"? The structure will be different and will have new footage as well.

If he owns the footage outright, he is free to use it any way he sees fit, unless he has entered into prior agreements restricting its use. If for example he has signed an exclusivity deal with a distributor for a period of time, using the footage in another project may violate that agreement. It depends upon the language in the contract.
