transparent bg for text isn't transparent...

Hi, this is my first post.
anywho, usually the background's transparent when I use Default text, but lately it's been just black even though it's on transparent in Properties... I usually insert the text in the first track with the main footage.
If I put it in a second track, it only shows above and below the footage in the black area (it goes behind the footage).
After some experimenting, I found that if I put footage in the second track to use its sound or something, the text's background becomes transparent.
I'm suspicious that the first track's set so that footage is always in front of other layers...

Track 1: title
Track 2: Background video
You can't put the title ON THE SAME TRACK as the video or it will REPLACE the video. Instead, always put it on a track above the video. The the video will show through in the transparent areas.
