Mpeg1 for captions dropping frames

My client wanted captions for this DVD project and told me to provide the caption company with an MPEG-1 with a TC window in the upper right. Every time I compress the mpeg1 in compressor it will drop frames in play back in QT, the exact frames, every time. The film start TC is one hour and it will drop/skip frame 01:00:20:20 and a few other frames each attempt at compression. Those TC frames are there in the source footage in FCP with a TC reader filter applied. Any ideas on what's going on here? or how to make a frame accurate mpeg-1?
The caption company also mentioned they can take some sort of DivX AVI? Would this be a more reliable option?
