Compliant BD Elementary streams need transcoding?

I'm trying to author a Blu-ray project in Encore CS3 and when I bring in streams that are blu-ray compliant (encoded in Procoder 3) encore lists their status as untranscoded. If I go and have Encore transcode to a compliant stream for me, I go to the BDMV folder, and reimport the .m2ts file that was created by encore, it says untranscoded as well.
When I import the same files into DVDit Pro HD and I go to build a BD image, it builds the image without re-transcoding the footage.
What am I missing in terms of setting up the project in Encore or my encoder settings in various applications which would yield compliant streams?
