[Mark J.] "If someone has bought soundkeys and uses it to have audio affect the speed of the video, that is an infringement- "

Not according to the language of this patent.

Claims 1 - 13, 16 - 28, 31 - 37 of patent 6,744,944 each refer to the modifying, analysis or resequencing of a first input signal comprised of "video." This simply is not what Sound Keys does. Sound Keys generates key frames based upon audio, not video.

Claims 15 and 30 refer to real-time output of which AE is not capable of supporting.

Claims 14 and 29 do make refererence to the analyzing of an audio input signal.

"14. A method for outputting an output video signal, comprising a series of frames, based upon at least one characteristic of an input audio signal..."

Sound Keys outputs key frames. It is not a method for outputting an output video signal.

"29. A computer readable medium storing a computer program for outputting an output video signal, comprising a series of frames, based upon at least one characteristic of an input audio signal..."

Sound Keys outputs key frames. The product is not based on an analysis of an input video signal nor does the product output a third video signal as a result of any analysis of a second signal (audio or video).

The invention covered by this patent consists of an input video signal, analysis of at least one characteristic of a second (audio) input signal and an output of a third video signal comprised of the primary input video signal. Sound Keys does analyze an audio input signal, but it does not output a video signal and does not analyze a primary video signal. Where is the infringement?

Based on the language in claims 1 - 37 of this patent, Sound Keys as a product nor the use of it by individuals does not come any where close to violating the claims of this patent. However, this patent does appear to have some merit based upon how some aspects of AE operate. I would love to see the patent owner try to inforce this patent with Adobe!
