Glad you were able to figure it out! --I'm afraid I did more to confuse than illuminate the issue. :(
Note that you
should
be able to perform booleans without needing to close the figure, though. What version of Maya are you using? The script I posted provides, for me using Maya 4.0, a successful boolean without the need to close the top and bottom (so long as the sphere doesn't overlap part of a border edge). Extruding poly faces from a plane and then booleaning them also works for me--as long as Keep Faces Together is toggled on.
So it seems there's still something funny going on, but if you've found a solution to the original problem, then we can quit while we're ahead. ;)
